Who is the controller of your personal data?
The Dutch company Frankie's is the controller of the personal data you submit to us and is responsible for your personal data under applicable data protection law.

Where do we store your data?
The data we collect from you is stored within the European Economic Area (“EEA”), but may also be transferred to and processed in a country outside the EEA. Such transfer of your personal data will be carried out in compliance with applicable law.
Who has access to your data?
Your data may be shared within the Frankie's company.
We will never forward, sell or exchange your data with third parties outside Frankie's for marketing purposes. Data forwarded to third parties is only used to provide you with our services. The categories of third parties are listed under each specific process below.
What is the legal ground for processing?
For each specific processing of personal data we collect from you, we will inform you whether the provision of personal data is statutory or required to enter into a contract, and whether it is an obligation to provide the personal data and the possible consequences if you choose not to.
What are your rights?
Right of access:
You have the right to request information about the personal data we hold about you at any time. You can contact info@frankies.nl who will provide you with your personal data via email.
Right to portability:
Whenever Frankie's' processes your personal data by automated means based on your consent or based on an agreement, you have the right to obtain a copy of your data in a structured, commonly used and machine-readable format, transferred to you or to another party. This only covers the personal data you have submitted to us.
Right to rectification:
You have the right to request correction of your personal data if it is incorrect, including the right to have incomplete personal data completed.
Right to erasure:
You have the right to delete any personal data processed by Frankie's' at any time, except for the following situations:
* you have an ongoing matter with Customer Service
* you have an open order that has not yet been shipped or partially shipped
* you have an outstanding debt to Frankie's', regardless of payment method
* you are suspected of having misused our services in the past four years
* your debt has been transferred to a third party within the last three years or one year for deceased customers
* your credit application has been rejected within the last three months
* if you have made a purchase, we retain your personal data in connection with your transaction for bookkeeping rules
Right to object to processing based on legitimate interest:
You have the right to object to processing of your personal data that is based on a legitimate interest of Frankie's'. Frankie's' will not continue to process the personal data unless we can demonstrate a legal ground for the process which overrides your interest and rights or due to legal claims.
Right to object to direct marketing:
You have the right to object to direct marketing, including profiling for direct marketing purposes.
If you no longer wish to receive direct marketing, you can:
* follow the instructions in every marketing email
Right to restriction:
You have the right to request that Frankie's' restricts the processing of your personal data under the following circumstances:
* if you object to processing based on Frankie's legitimate interest, Frankie's' shall restrict all processing of such data pending verification of the legitimate interest,
* if you claim that your personal data is incorrect, Frankies must restrict all processing of such data pending verification of the accuracy of the personal data,
* if the processing is unlawful you can oppose the erasure of personal data and instead request the restriction of the use of your personal data,
* if Frankies no longer needs the personal data but it is required for you to make or defend legal claims.

Updates to our Privacy Policy:
We may need to update our Privacy Policy. The latest version will always be available on our website. We will communicate any material changes to the Privacy Policy, for example the purpose of use of your personal data, the identity of the Controller, or your rights.
Klarna Privacy Policy:
“In order to offer you Klarna’s payment methods, we may pass your personal data in the form of contact and order details to Klarna during checkout so that Klarna can assess whether you qualify for their payment options and tailor these options for you. Your personal data is processed in line with Klarna’s privacy policy.”
